Katsina CJ Warns: Inadequate Funding Puts Judicial Independence at Risk

Justice Musa Danladi Abubakar, the Chief Judge of Katsina State, has issued a stern warning about the detrimental effects of insufficient funding on the judiciary’s independence and the public’s trust in the justice system.

In a recent discussion, Justice Abubakar identified inadequate financial support as the primary obstacle confronting the courts. He highlighted that although the judiciary functions as an autonomous branch of government, it is frequently treated as a subordinate agency reliant on the executive branch for resources.

“The judiciary stands as an equal pillar of government, not merely an agency,” he asserted. “However, the funds allocated to it are often delayed or fall short of what is necessary. Without adequate financing, we are unable to summon witnesses, carry out thorough investigations, or handle the logistical demands of court proceedings. This situation directly undermines the administration of justice.”

He further stressed that the lack of financial support not only hampers court activities but also infringes on citizens’ rights to prompt and equitable trials. With limited personnel and outdated facilities, courts find it increasingly difficult to manage the growing volume of cases fueled by population increases and security challenges.

“Speedy justice is unattainable when fundamental resources are missing. Even initiatives like community mediation centers and restorative justice programs face severe limitations due to budget constraints. Ultimately, it is the public who bear the brunt of delayed justice,” he explained.

Justice Abubakar pointed out that chronic delays in the judicial process are exacerbated by underfunded investigations and prosecutions, causing many criminal cases-including those involving terrorism and corruption-to linger unresolved for years. Overcrowding in prisons remains a persistent issue despite efforts to release detainees who are either wrongfully held or eligible for bail.

He reaffirmed his goal that within five years, no civil or criminal case in Katsina courts should extend beyond one year. However, he acknowledged that achieving this objective is unattainable without granting the judiciary financial independence.

The Chief Judge called on both federal and state governments to fully enforce the constitutional provision for judicial financial autonomy.

He emphasized that only through assured and direct funding can the judiciary fulfill its constitutional mandate free from external influence.

“I want my tenure to be remembered as a period when the Katsina judiciary delivered justice that was prompt, impartial, and accessible. Yet, this vision cannot be realized if courts continue to suffer from financial neglect. True judicial independence is inseparable from financial independence,” he concluded.
