The defense attorney representing 22-year-old Tyler Robinson, accused of murdering conservative activist Charlie Kirk, has requested additional time to thoroughly examine the substantial evidence before deciding whether to pursue a preliminary hearing.
“We anticipate receiving an overwhelming amount of digital evidence,” Kathryn Nester, Robinson’s counsel, informed the court on Monday.
A preliminary hearing is intended to assess if sufficient proof exists to proceed to trial. The hearing was held in Provo, near Utah Valley University in Orem, where students continue to grapple with the aftermath of the September 10 shooting and the subsequent extensive manhunt.
Robinson surrendered voluntarily at his local sheriff’s office in southwestern Utah, a location over three hours away from the shooting scene. Authorities have since disclosed text messages and DNA evidence linking him to the crime.
Before the attack, Robinson left a message for his partner expressing his intent to eliminate one of the country’s foremost conservative figures. Utah County Attorney Jeff Gray shared with reporters that Robinson wrote, “I had enough of his hatred,” referring to Kirk.
Kirk, a prominent ally of former President Donald Trump who influenced young voters toward conservative ideals, has become a rallying point for Republicans determined to advance his political agenda.
Trump has labeled Kirk a “martyr” for liberty and vowed to intensify efforts against what he terms the “radical left.”
In the wake of Kirk’s death, numerous individuals across the nation-including educators, public servants, and media figures-have faced repercussions for commenting on the case. Notably, late-night host Jimmy Kimmel experienced a temporary suspension of his show on ABC.
Turning Point USA, Kirk’s political organization based in Arizona, mobilized young evangelical Christians through podcasts, social media, and campus events. Several leading Republicans, such as Utah Governor Spencer Cox and Senator Mike Lee, are stepping in to participate in upcoming university events Kirk was scheduled to attend, including one at Utah State University.
During Monday’s proceedings, Judge Tony Graf acknowledged the high-profile nature of the case and emphasized the importance of safeguarding the constitutional rights of both Robinson and the victims throughout the legal process.
“Our duty is to conduct this case with integrity, respect, and thoroughness,” Judge Graf stated. “I urge all parties to commit fully to ensuring justice is served impartially. Neither Mr. Robinson nor the citizens of Utah deserve anything less.”
The court scheduled the next hearing for October 30.
